Article 1 - Purpose
These General Terms and Conditions of Sale (GTC) govern the sales of products made on the Nocturnly website (hereinafter referred to as "the Store"), operated in accordance with these conditions. Any order placed on the Store implies the unreserved acceptance of these GTC by the customer.
Article 2 - Products
The products offered for sale are those listed on the Store on the day of consultation by the customer, within the limits of available stock. Nocturnly reserves the right to modify the product assortment at any time.
Article 3 - Prices
The prices of the products are indicated in euros, all taxes included (TTC). Nocturnly reserves the right to modify its prices at any time, it being understood that the price applicable to an order is the one in force at the time the order is validated. Delivery costs are indicated before the final validation of the order and are added to the price of the products.
Article 4 - Order
The customer selects the products they wish to order, adds them to their cart, then validates their order after checking its details and total price. Validation of the order constitutes acceptance of these GTC. An order confirmation is sent to the customer by email.
Article 5 - Payment
Payment is made online, at the time of the order, by credit card or any other payment method offered on the Store. Transactions are secure. The customer's account is only debited after final validation of the order.
Article 6 - Delivery
The terms, deadlines, and delivery costs are detailed in the Store's delivery policy. Nocturnly undertakes to make its best efforts to deliver the ordered products within the indicated deadlines, without these constituting a firm commitment, particularly in cases of exceptional circumstances.
Article 7 - Right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to give reasons or pay penalties. The applicable conditions and exceptions are detailed in the return and refund policy.
Article 8 - Guarantees
All products supplied by Nocturnly benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code) and the legal guarantee against hidden defects (Articles 1641 et seq. of the Civil Code), independently of any commercial guarantee.
Article 9 - Liability
Nocturnly cannot be held responsible for the non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport, or in the event of misuse of the products by the customer.
Article 10 - Intellectual Property
All elements of the Nocturnly website (texts, images, logos, graphic elements) are the exclusive property of Nocturnly or its partners and are protected by intellectual property law. Any reproduction or representation, total or partial, is prohibited without prior authorization.
Article 11 - Personal Data
The processing of customers' personal data is described in our privacy policy, accessible from the footer of the site.
Article 12 - Mediation and Disputes
In the event of a dispute, the customer may freely resort to a consumer mediator for the amicable resolution of the dispute, in accordance with Articles L616-1 et seq. of the Consumer Code. Failing amicable resolution, any dispute shall fall within the jurisdiction of the competent French courts.
Article 13 - Applicable Law
These GTC are subject to French law.
